Terms and Conditions

By accessing or using Kinesiai, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, do not use Kinesiai.

Kinesiai is operated by Aevient, LLC, a Missouri limited liability company, with a business address at 231 S Bemiston Ave Ste 850, PMB #773204, Saint Louis Missouri 63105-1920 US.

You must be legally capable of entering into a binding agreement to use Kinesiai. You are responsible for maintaining the confidentiality of your account and for activities that occur under your account.

Kinesiai currently supports Sign in with Apple and email login. Additional login methods may be added in the future.

Kinesiai is intended for fitness, wellness, and general informational purposes only. Kinesiai does not provide medical advice, diagnosis, or treatment. Body scan features, recommendations, and analytics are not medical tools and should not be relied on for medical decisions.

Always seek guidance from a qualified healthcare professional for medical questions or concerns.

You may provide photos, workout data, profile information, and other content through Kinesiai. You retain ownership of your content, but you grant Aevient, LLC the rights needed to host, process, analyze, display, and use that content to operate and improve Kinesiai for you.

You represent that you have the rights necessary to submit the content you upload and that your content does not violate any law or the rights of others.

You agree not to:

• Use Kinesiai in violation of applicable law or regulation.
• Interfere with, disrupt, or attempt to gain unauthorized access to the service.
• Upload malicious code or abusive, infringing, or unlawful content.
• Reverse engineer, scrape, or misuse the service except where prohibited by law from restricting that activity.
• Use Kinesiai in a way that could harm Aevient, LLC, other users, or third parties.

Kinesiai may use third-party AI and language model services to generate personalized recommendations based on information you provide. These outputs may not always be accurate, complete, or suitable for every situation. You are responsible for using your own judgment before acting on recommendations.

If you connect Apple HealthKit or other third-party services, you authorize Kinesiai to access the data you choose to share for the purpose of providing app functionality. HealthKit data is processed transiently and is not stored server-side by Kinesiai.

Kinesiai is offered internationally, but some features may not be available in every country or device environment. We may modify, suspend, or discontinue all or part of the service at any time.

You may stop using Kinesiai at any time. In-app account deletion is available. We may suspend or terminate access if we reasonably believe you have violated these Terms, created risk for the service, or where required by law.

Kinesiai is provided on an "as is" and "as available" basis to the maximum extent permitted by law. Aevient, LLC disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and that the service will be uninterrupted, error-free, or fully accurate.

To the fullest extent permitted by law, Aevient, LLC and its affiliates, officers, employees, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, goodwill, or business interruption arising out of or related to your use of Kinesiai.

To the fullest extent permitted by law, the total liability of Aevient, LLC for claims arising out of or relating to Kinesiai will not exceed the greater of the amount you paid to use the service in the 12 months before the claim arose or US$100.

You agree to defend, indemnify, and hold harmless Aevient, LLC and its affiliates, officers, employees, and agents from and against claims, liabilities, damages, losses, and expenses arising out of your use of Kinesiai, your content, or your violation of these Terms or applicable law.

These Terms and Conditions are governed by the laws of the State of Missouri, without regard to conflict of laws principles.

We may update these Terms and Conditions from time to time. If we make material changes, we will provide notice through the app or by other appropriate means. Your continued use of Kinesiai after updated terms become effective means you accept the revised terms.
